Bir Duino Kyrgyzstan Calls on the Government to Reject the Return of the Death Penalty

WLP partner Bir Duino Kyrgyzstan, a leading human rights organization, has issued a strong call to the Government of Kyrgyzstan to reject recent proposals to reinstate the death penalty. The organization warns that this measure would represent a major setback for justice, democracy, and human rights in the country.

In its legal analysis, Bir Duino highlights the tragic consequences experienced by countries that have reinstated the death penalty, urging Kyrgyzstan to remain “a country that chooses life, not death.” The organization’s analysis emphasizes that bringing back capital punishment would contradict the nation’s obligations under international law, including the Second Optional Protocol to the International Covenant on Civil and Political Rights, which calls for the abolition of the death penalty.

Punishment Without Prevention

The proposal to reintroduce capital punishment was put forward following the rape and murder of a young woman, a crime that has shaken the country and sparked public outrage. While Bir Duino shares the national grief and calls for decisive action to address sexual violence, it stresses that the death penalty does not prevent such crimes.

As Bir Duino and Equality Now explain in their joint statement, international evidence shows that harsh punishment alone does not reduce the level of sexual violence. Instead, it risks deepening systemic injustice.

The organizations warn that if the death penalty is reinstated, judges and prosecutors may demand more evidence than a victim’s testimony, out of fear of judicial error in cases with irreversible consequences. This would lead to fewer convictions and discourage victims from reporting crimes, ultimately undermining the justice system and leaving survivors even more vulnerable.

A Call for Justice, Not Retribution

Bir Duino urges the Kyrgyz government to channel public demand for justice into comprehensive reform, not retribution. The organization calls for coordinated efforts to:

  • Strengthen investigation and prosecution of sexual and gender-based violence;
  • Ensure victims’ testimonies are valued and protected in court;
  • Improve the responsiveness and accountability of law enforcement; and
  • Promote education, prevention, and rehabilitation initiatives that address root causes of violence.

The organization emphasizes that effective justice systems protect life, dignity, and human rights, while punitive measures like the death penalty only perpetuate cycles of harm.
