UPDATE: WLP Kyrgyzstan- Tolekan Ismailova is Denied Fair Trial

On November 27, 2012, the Inter-District Court of Bishkek dismissed a complaint brought to the court by Tolekan Ismailova, Director of WLP Kyrgyzstan/Human Rights Center-“Citizens Against Corruption” and the human rights Bir Duyno Film Festival. Ismailova filed the complaint with the court after the State Commission of Religious Affairs filed a warning against her and seized the film “I am Gay and Muslim” to prevent it from being screened during the Bir Buyino Film Festival, on September 28, 2012.

Women’s Learning Partnership has learned that on the date of the hearing the Inter-District Court of Bishkek dismissed the case after only thirty minutes in court and before allowing the case to go to argument. The National Security Committee submitted a request to the court, which was not made public, leading the court to determine that Ismailova had no grounds for complaint. This denial of her legitimate request for a fair trial is in clear violation of the Code of Civil Procedure of the Kyrgyz Republic. Ismailova plans to appeal this decision.

Furthermore, WLP Kyrgyzstan/Human Rights Center-“Citizens Against Corruption” has filed an appeal to overturn the court decision banning the screening of the film “I am Gay and Muslim” and this case will be heard before the Bishkek City Court on December 5, 2012.
